You may take up the Membership offer on our Website by completing the online form and completing the payment details for the membership fee. Please note that JRPP does not offer refunds of the membership fee under any circumstances, unless obliged to under the laws of Australia.
The Website may only be used by individuals aged eighteen (18) years or older, and only these eligible persons may take up Membership. If the User is under the age of eighteen (18) years, the User’s parent or guardian must review these Terms with the User and any use of the Website by the User is consented to by the User’s parent or guardian.
Use by the User of the Website and the Membership and any Content and User Information transmitted in connection with the Website is limited to the contemplated functionality. The User agrees that his or her use of the Website and must comply with these Terms. In no event may the Website be used in a manner that (a) harasses, abuses, stalks, threatens, defames or otherwise infringe or violate the rights of any other party (including but not limited to rights of publicity or other proprietary rights); (b) is unlawful, fraudulent or deceptive; (c) uses technology or other means to access the Website or Content that is not authorized by JRPP; (d) use or launch any automated system, including without limitation, “robots,” “spiders,” or “offline readers,” to access the Website or Content; (e) attempts to introduce viruses or any other computer code, files or programs that interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment; (f) attempts to gain unauthorized access to JRPP computer network or user accounts; (g) encourages conduct that would constitute a criminal offense, or that gives rise to civil liability; (h) violates these Terms; (i) attempts to damage, disable, overburden, or impair JRPP servers or networks; (j) fails to comply with applicable third party terms and the User must not, and must not attempt to reverse engineer the software code in the Website and/or the Application; or (k) uses any profanity or language which JRPP determines is offensive in any way (Acceptable Use). JRPP reserves the right, in its sole discretion, to terminate any Membership or assert legal action with respect to or use of the Website or Membership that JRPP reasonably believes is or might be in violation of these terms of Acceptable Use, but JRPP failure or delay in taking such actions does not constitute a waiver of its rights to enforce these Terms.
At JRPP’s request, the User agrees to defend, indemnify, and hold harmless JRPP and its parent and other affiliated companies, and their employees, contractors, officers, and directors from any and all claims, suits, damages, costs, lawsuits, fines, penalties, liabilities, expenses (including legal fees) that arise from the User’s use or misuse of the Website and the Membership, violation of these Terms or violation of any rights of a third party. JRPP reserves the right to assume the exclusive defence and control of any matter otherwise subject to indemnification by the User, in which event the User will co-operate in asserting any available defences. In the event of any third party claim that the Website or User’s possession and use of the Website or the Membership infringes that third party’s intellectual property right, JRPP will be solely responsible for the investigation, defence, settlement and discharge of any such intellectual property infringement claim.
JRPP is providing the Website and the Membership to the User “as is” and the User is using the Website and the Membership at his or her own risk. To the fullest extent allowable under Australian laws, or any other applicable law if more appropriate, JRPP disclaims all warranties and conditions, whether express or implied, including any warranties or conditions that the Website is merchantable, or satisfactory quality, reliable, accurate, fit for a particular purpose need or use, non-infringing or free of defects or errors, or able to operate on an uninterrupted basis, or that the use of the Website or the Membership by the User is in compliance with the laws applicable to the User, or that the User Information transmitted in connection with the Website will be successfully, accurately or securely transmitted.
To the fullest extent allowable under Australian laws, or any other applicable law if more appropriate, in no event shall JRPP, its related entities, officers or assigns (a) be liable to the User with respect to the use of the Website (b) be liable to the User for any direct, indirect, special, incidental, consequential, liquidated or exemplary damages, including, but not limited to, damages for loss of opportunity, goodwill or profits, theft or corruption of User Information, the inability or unsuitability of the Website or the Membership. The User’s sole remedy is to cease all use of the Website and Membership. To the fullest extent allowable under Australian laws, or any other applicable law if more appropriate, in no event shall the aggregate liability of JRPP, its related entities, officers or assigns, whether in contract, tort (including negligence, strict liability or any other theory, arising out of or relating to the use of or inability to use the Website or Membership, exceed AUD$50.00. Certain legislation, including the Competition and Consumer Act 2010 (Cth), may imply warranties or conditions or impose obligations upon us which cannot be excluded, restricted or modified or cannot be excluded, restricted or modified except to a limited extent. These Terms must be read subject to these statutory provisions. If these statutory provisions apply, to the extent to which JRPP are able to do so, the liability of JRPP and its affiliates under those provisions will be limited, at its option to: (1) in the case of goods, the replacement of the goods or the supply of equivalent goods; the repair of the goods; the payment of the cost of replacing the goods or of acquiring equivalent goods; or the payment of the cost of having the goods repaired; and (2) in the case of services, the supplying of the services again; or the payment of the cost of having the services supplied again.
Marks, Website and Content
JRPP and any JRPP logo and other JRPP trademarks, service marks, graphics and logos used in connection with the Website are trademarks of JRPP and must not be copied, imitated or used, in whole or in part, without the prior written permission of JRPP. The Website and the content are protected by copyright, trademark, patent, trade secret, international treaties, laws and other proprietary rights, and also may have security components that protect digital information only as authorized by JRPP or the owner of the content.
JRPP may decide from time to time to offer promotions or incentives to Users at its discretion. JRPP assumes no responsibility for the use of any such promotions or incentives by Users.
Governing Law and Jurisdiction
These Terms are governed by the laws of the State of New South Wales in Australia, without regard to conflict of laws rules. The United Nations Convention on Contracts for the International Sale of Goods shall have no applicability. The User irrevocably consents to the exclusive jurisdiction of the courts of the State of New South Wales in Australia for purposes of any legal action arising out of or related to the use of the Website or these Terms.
JRPP reserves the right to change or modify these Terms or any other JRPP policies related to use of the Website at any time and at its sole discretion by posting revisions on the JRPP website. Continued use of the Website following the posting of these changes or modifications will constitute acceptance of such changes or modifications.
If any provision of these Terms shall be deemed unlawful, void or for any reason unenforceable, then that provision shall be deemed severable from these Terms and shall not affect the validity and enforceability of any remaining provisions.
